The pool bike scheme is not yet active and the following terms and conditions are indicative and subject to change.
Use of our shared pool bikes is subject to the following terms and conditions. You accept these terms and conditions by using one of the shared bikes.
You use our shared pool bikes entirely at your own risk and you bear any and all legal and financial responsibilities for doing so. We may require you to replace any lost, damaged or stolen equipment on a like for like basis.
Please read and understand these terms and conditions carefully.
The User
– The user must be over the age of 18.
– The user must have provided copies of both their photographic ID and proof of address to THINQTANQ Plymouth Ltd prior to taking one of our pool bikes.
– The user must be eligible, legally and by membership to borrow the bike and must have the bike booked out using the provided booking system.
– The user is strongly urged to take out adequate personal injury insurance whilst using one of our bikes.
– The user must wear appropriate safety equipment.
– The user is responsible for the bike borrowed and it is the users responsibility to keep the bike safe from
damage, loss or theft, use it in a proper manner and not subject it to any misuse or undue wear and tear. In the event that these occur you will be subject to an excess of £150 charged via your stored payment details and depending on the situation we may seek to recover the whole cost of replacement.
– The user will not assign, transfer or subcontract the bike to another party.
– The bike remains the property of THINQTANQ Plymouth Ltd at all times and the user shall have no right, title or interest in the bike.
– The user must inspect and ensure that they are happy with the condition and operation of the bike prior to using it. Any defects in performance should be notified to THINQTANQ Plymouth Ltd and the bike should not be used.
Borrowing and returning the bike
– Pick up and returns can only be done during opening office hours 9am to 5pm (Monday to Friday excluding
Bank Holidays).
– The user must return the bike in the condition it was lent out or be subject to pay for any damage. Any
damage caused by neglect is the users responsibility and will be charged for.
Using the bike
– When using the bike the user must obey the Highway Code and all applicable laws and be considerate of all other road users and
pedestrians.
– If THINQTANQ Plymouth Ltd is made aware of any antisocial behaviour whilst using the bike, the bike will be recalled
immediately, the bike use terminated, and the user will be excluded from using a bike from THINQTANQ Plymouth Ltd in the future.
– Lights will be provided and must be used at all time after sunset in accordance with the law.
– The bike must not be left unattended for more than 2 hours where there is public access.
– You must not tamper with or alter the settings on any of the pool bikes to affect or increase their performance. Any bike is provided in a road legal state and if alterations have been made from this condition, we cannot be held responsible if you are found to be using the bike not in accordance with applicable laws.
Locking the bike
– The bike must be locked through the frame with the lock provided by THINQTANQ with the bike.
– When not in use the bike must be secured inside a lockable building i.e.:
• House/flat,
• Garage/outbuilding,
• Shed, where all external doors and windows are locked, and theft is occasioned by a forcible and/or violent
entry. In this instance, the bicycle must be stored out of sight,
• Communal hallway,
• Communal outbuilding,
• Purpose-built bike container where all external doors and windows are locked and the bicycle has been
secured through its frame to an immovable object.
– If the bike cannot be locked inside a secure building then it must be locked through the frame to a cycle parking
stand or an immoveable object with a minimum height of three metres. An immoveable object is any solid object
fixed in, or on to, concrete or stone, which is not capable of being undone, removed, or lifted under or over.
– You must use the Gold standard lock provided with the bike to secure it and it must be locked in a well lit, area that is not secluded.
If the bike is lost or stolen
– If the bike is stolen, the user is responsible for reporting the incident to the Police within 24 hours, and a crime
reference number must be provided by the user to the team at THINQTANQ Plymouth Ltd within 24 hours via phone or email.
– If the bike is lost or stolen, an excess of £150 will be required to be paid.
If you break down or are involved in a collision
– If the user breaks down on the bike, they are required to inform THINQTANQ Plymouth Ltd by phone or email and return the bike to the premises at THINQTANQ, Fairbairn House, Higher Lane, Plymouth, PL1 2AN within 24 hours of the event. All reasonable precautions are taken to ensure the bikes are suitable for use but no responsibility for loss or damage as a result of user error, mechanical failure or force majeure will be accepted.
– If the bike is involved in a collision, the user is responsible for reporting the incident to the Police within 24 hours, and a traffic case reference number must be provided by the user to THINQTANQ Plymouth Ltd within 24
hours via phone or email.
